1. Acceptance of Terms
By accessing or using GrowthKickstarter(the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not access or use the Service. Continued use of the Service after any updates constitutes your acceptance of the revised terms.
2. Description of Service
GrowthKickstarter provides agencies with a white-label Instagram growth fulfilment platform. The Service enables agency partners to offer organic Instagram growth to their clients under their own brand, without managing fulfilment internally. All growth activity is conducted using real human activity, targeted engagement, and organic audience development methods.
3. Eligibility and Account Responsibilities
The Service is available to registered businesses and professional agencies only. By signing up, you represent that you are authorised to enter into this agreement on behalf of your business. You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account. You must notify us immediately of any suspected unauthorised use.
4. No Guarantee of Results
We do not guarantee specific outcomes including follower counts, engagement rates, reach improvements, or profile visit numbers. Results vary based on factors outside our control, including your clients' content quality, account history, niche competitiveness, audience behaviour, and changes to Instagram's algorithm or policies. Historical case study data is provided for illustration only and does not constitute a guarantee.
5. Compliance with Platform Policies
The Service is designed to operate through real human activity in a manner consistent with Instagram's terms of use. GrowthKickstarter is not affiliated with, endorsed by, or in any way officially connected with Instagram or Meta Platforms, Inc. We cannot be held liable for any actions taken by Instagram against client accounts using the Service, including account restrictions, suspensions, or changes in engagement resulting from platform algorithm updates or policy enforcement.
6. Payment and Billing
The Service is billed on a recurring monthly subscription basis per client slot. By subscribing, you authorise us to charge your nominated payment method at the start of each billing cycle. Volume pricing tiers are applied automatically based on your active client count. All payments are non-refundable except where required by applicable law or agreed in writing. You are responsible for maintaining accurate and current billing information.
7. Cancellation Policy
You may cancel individual client slots or your entire subscription at any time by contacting us at support@growthkickstarter.com or through the dashboard. Cancellations must be submitted at least 24 hours before the end of your current billing cycle to prevent renewal charges for the following period. Access to the Service continues until the end of the paid billing period.
8. Account Access and Security
To deliver the Service for your clients, you will be required to provide Instagram account credentials through the dashboard. We implement industry-standard encryption and security measures to protect all account information. Credentials are not stored in plain text and are handled with strict access controls. You are responsible for ensuring you have the legal authority and client consent to provide access to any Instagram accounts submitted through the Service.
9. White-Label and Confidentiality
The Service is provided on a white-label basis. You may present the growth service to your clients under your own agency brand. You agree not to disclose GrowthKickstarter as your fulfilment provider without our prior written consent. Similarly, we will not publicly disclose your agency as a partner without your consent.
10. Service Availability
We strive to maintain continuous service availability but do not guarantee uninterrupted access. Scheduled maintenance, platform updates, or circumstances outside our control may result in temporary disruptions. We will endeavour to provide advance notice of planned downtime where possible.
11. Limitation of Liability
To the maximum extent permitted by law, GrowthKickstartershall not be liable for any indirect, incidental, special, or consequential damages arising from your or your clients' use of the Service. This includes but is not limited to loss of followers, engagement, revenue, or account access resulting from Instagram's actions, algorithm changes, or policy enforcement. Our total liability for any claim shall not exceed the amount paid by you in the three months preceding the claim.
12. Indemnification
You agree to indemnify and hold harmless GrowthKickstarter, its directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, your clients' use of the service you resell, or your infringement of any third-party rights.
13. Amendments
We reserve the right to update these Terms of Service at any time. Changes will be posted to this page with a revised date. Your continued use of the Service after any change constitutes acceptance of the updated terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Victoria, Australia. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Victoria, Australia.
